ADJUSTMENT OF STATUS

MARRIAGE-BASED GREEN CARD

  • Fundamentals

Adjustment of Status is the process that allows someone already living in the United States to apply for a Green Card (lawful permanent residence) without leaving the country. This option is available to certain individuals who meet the eligibility requirements and want to move from a temporary status—such as a student visa, work visa, or even an expired visa—into permanent residency.

  • Who Can Apply?

To be eligible for Adjustment of Status, you generally must:

Be physically present in the U.S. at the time of applying.

Have been inspected and admitted or paroled into the U.S. by an immigration officer. (Those who entered without inspection or violated status may face limited options.)

Qualify for a Green Card through family, employment, asylum, or another eligible category.

Be admissible to the U.S., meaning you do not have certain criminal convictions, immigration violations, or health-related issues.

  • Additional Requirements

Medical Examination: A medical report from a USCIS-approved civil surgeon.

Biometrics Appointment: Fingerprinting and background checks.

Interview: In some cases, USCIS may require an in-person interview to review your application and ask questions.
