PETITION TO REMOVE CONDITIONS ON RESIDENCE

The Petition to Remove Conditions (Form I-751) is required for conditional residents who obtained their green card through marriage to a U.S. citizen or lawful permanent resident. Filing this form removes the conditions on their permanent resident status and allows them to receive a 10-year green card.
Conditional residency is granted when the marriage was less than two years old at the time of green card approval. To continue permanent resident status, applicants must prove that the marriage was bona fide (genuine) and not entered into for immigration purposes.

Who Can Apply?
Conditional Status: You must currently hold a conditional green card (issued when the marriage was under 2 years at approval).
Marriage: Most applicants must file jointly with their spouse, showing the marriage is real and ongoing.
Proof of Bona Fide Marriage: Evidence is required, such as joint financial records, leases, insurance policies, photos, and other documents proving the relationship is authentic.
Timely Filing: The petition must be filed within the 90-day window before your conditional green card expires. Filing late can result in loss of permanent resident status.
Waiver Eligibility: If you cannot file jointly, you may request a waiver by showing:
The marriage ended in divorce or annulment
You were a victim of abuse or extreme cruelty
Removal from the U.S. would cause extreme hardship
